Section 23 of the ADSp limits the statutory liability for loss of or damage to goods according to Section 431 of the German Commercial Code (HGB) to € 5.00 per kg for goods in the forwarder’s custody; in the case of a contract of multimodal carriage – including sea transport – to 2 SDR (Special Drawing Rights) per kg and above this per claim or event to € 1 million or 2 SDR per kg, whichever is the greater.
Section 27 ADSp shall not apply to shipments which are subject to the field of application of the Montreal Convention. Section 27 ADSp consequently does not count as an agreement of other maximum liability amounts as defined by Section 25 of the MC. The place of performance and court of jurisdiction shall be Aachen.
The German standard terms and conditions (ADSp) are general terms and conditions of business which are jointly recommended by the Deutscher Speditions- und Logistikverband e.V. (German Association of Freight Forwarders and Logistics Companies).
